APPLICANT REQUESTS THAT:
The Fitness Assessment (FA), dated 08 Mar 2010 be corrected in the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:
He had a composite score of 73.30 during the contested FA, which precluded him from obtaining a marginal overall rating.
AFI 10-248, (which was the governing fitness Program instruction until 1 July 10) states that a score of 70 or above will be considered passing and scores of 70-74.99 will be considered marginal while scores lower than 70 will be rated as poor.

STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in the grade of First Lieutenant (0-2).
On 08 Mar 10, the applicant participated in the contested FA and attained a composite score of 73.30, which is reflected as a poor rating in the AFFMS.

AIR FORCE EVALUATION:
AFPC/DPSIM recommends approval by deleting the FA from system. IAW AFI 10-248 Paragraphs 3.3.3. he should have received a "Marginal rating for the contested FA. However, there has been a change to the fitness program and were unable to make the update, as AFFMS cannot calculate scores based on 2010 standards, nor can it reflect Marginal ratings.
A complete copy of the AFPC/DPSIM evaluation, with attachments, is at Exhibit B.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation, with attachments, was forwarded to the applicant on 06 Dec 13 for review and comment within 30 days. As of this date, no response has been received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the existence of an error or injustice. After thoroughly reviewing the evidence of record and noting the applicants contentions, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the contested FA should be corrected. Furthermore, since AFFMS will not allow for the correct update, we recommend the applicants records be corrected as indicated below.

THE BOARD DETERMINES THAT:
The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that the Fitness Assessment, dated 8 Mar 2010 be removed from the Air Force Fitness Management System.

Since his 21 April 2010 FA was removed from his record, which was the basis for his demotion action, his rank should be restored. There is no demotion action or demotion order in his personnel records. The applicant contends that his former grade should be restored because his demotion was based upon four consecutive fitness assessment (FA) failures, but one of the four failures was later declared void and removed from his records.
